Powers of Attorney and the role of the Notary Public

Notaries regularly receive requests to deal with Powers of Attorney for use overseas.  It is part of my role as a Notary Public to be able to advise you of any particular requirements for the jurisdiction in which the Power of Attorney is to be used – for example Indian Powers of Attorney require at least two witnesses and you certainly wouldn’t try to finalise a South African Power of Attorney by using blue ink!

Alongside the specific requirements of the country in which the Power of Attorney is to be used, is the need to ensure that the law of England and Wales is complied with when a document is being signed as a Deed – whether the power is being given by an individual or a business.

Sometimes a conflict of international laws arises and it is part of the specialised training of a Notary Public to ensure that these situations are recognised and due consideration given to how best to proceed.
